Privacy
Seller Direct® does not gather any personal information about the users of this
website unless voluntarily provided to us (example: the user fills out an online
form requesting a free market evaluation). Information submitted via our website
is not sold or distributed to any third-party organizations or individuals.
Seller Direct® tracks the use of this website including, but not limited to, the
number of users visiting the site, user domain names or ISP's, browser types, and
web pages accessed. Statistics are recorded on user activities, but no specific
information that would identify an individual is kept or utilized. Data collected
is used to improve the quality and design of our web site and enhance the user experience.

BROKERAGE PRIVACY
1.0 The Privacy Code of the Canadian Real Estate Association (CREA).
Seller Direct® adheres to and abides by the principles set out in the CREA Privacy
Code.
2.0 The Policy Statement
This Brokerage only collects personal information necessary to effectively market
and sell the property of sellers, to locate, assess and qualify properties for buyers
and to otherwise provide professional and competent real estate services to clients
and customers.
3.0 The Person in Charge
The Broker is the Privacy Officer responsible for privacy compliance in this Brokerage.
Their name shall be made available to consumers upon request. The responsibilities
of the Privacy Officer shall be to:
3.1 Establish, update and make available to the public upon request, information
on protection policies;
3.2 Ensure policies are implemented by other organizations to which data-processing
functions are outsourced;
3.3 Establish criteria for classification of information;
3.4 Evaluate the accessibility of sensitive information and take corrective action
where necessary;
3.5 Provide education to employees on the importance of information protection;
and
3.6 Attempt to resolve consumer privacy complaints to the satisfaction of the consumer.
4.0 The Collection, Use and Disclosure of Personal Information
4.1 Only the information necessary to facilitate the real estate transaction or
otherwise provide professional and competent service to clients and customers will
be collected;
4.2 No personal information shall be collected from an individual without first
obtaining the consent of the individual to the collection, use and dissemination
of that information;
4.3 Express consent (whether oral or written) must always be obtained except in
the following situation. Consent may be implied where the information is not sensitive
and where it can be reasonably assumed that the individual would expect the information
to be disclosed in this fashion;
4.4 The name of the privacy compliance officer will be provided to the individual
before or at the time of collection of personal information to answer any questions.
4.5 Once information is collected, it will be used and disclosed only for the purposes
disclosed to the individual;
4.6 All representation agreements must include the approved privacy clauses.
5.0 Disclosure for New Purpose
5.1 Anyone using or disclosing personal information for some new purpose that extends
beyond the consent already provided must obtain the express consent of the person
for that use;
5.2 Requests for information by law enforcement officials, lawyers, private investigators
or other agents or subpoenas for documents issued by the court must be referred
to the Broker.
6.0 Protecting Information
Information must be protected in a manner commensurate with its sensitivity, value
and criticality. This policy applies regardless of the media on which information
is stored, the locations where the information is stored, the systems used to process
the information, or the processes by which information is handled.
6.1 Collection and Disclosure
6.1.1 Meetings with customers and clients must take place in a place and manner
to ensure confidentiality;
6.1.2 Mail and faxes must be routed directly to the intended recipient;
6.1.3 Information should be available to other persons in the Brokerage only on
a need-to-know basis.
6.2 Storage
6.2.1 Filing cabinets designated by the office manager to contain personal, including
sensitive information, are to be kept secured at all times;
6.2.2 All personnel are to have computer passwords. These passwords are confidential
and are not to be shared with any unauthorized persons.
6.3 Destruction 6.3.1 This Brokerage has in place a record retention
and destruction policy consistent with the laws of this jurisdiction.
7.0 Accuracy of Personal Information
To ensure the quality of the information collected:
7.1 Insofar as possible, personal information should be collected directly from
the consumer;
7.2 Public property information (taxes, assessment data etc.) should be verified;
7.3 Disclaimers of accuracy in the form approved by the Brokerage should always
be attached to any disclosure of information.
8.0 Access to Personal Information
8.1 Copies of any privacy brochure approved by this office should always be available
to the public on the Brokerages website;
8.2 The individual set out in Section 3.0 as being responsible for privacy compliance
is the person responsible for responding to access requests and all such requests
will be referred to that person. All staff and salespersons will co-operate fully
with the privacy compliance officer in responding to requests;
8.3 On written request and appropriate identification satisfactory to the Brokerage,
an individual will be advised of personal information about him/her retained in
the Brokerage's records and whether they can access all, part, or none of their
personal information;
8.4 Where information cannot be disclosed (for example the information contains
reference to other individuals or is subject to solicitor-client privilege) the
individual will be given reasons for non-disclosure and the provision of PIPA that
applies;
8.5 An administrative fee in the amount of $10.00 will be charged to supply the
information.
8.6 This Brokerage will respond to a request from an individual to access information
within 30 days unless the organization has been granted an extension by the Information
and Privacy Commissioner.
9.0 Corrections to Personal Information and Changes in Consent
9.1 On written request, an individual may have corrections made to his/her personal
information that is retained in the Brokerage's records.
9.2 If information is not corrected, the individual's record must be annotated with
their request to correct the information.
9.3 Corrections to information that has been disclosed to other organization(s)
will be forwarded to the affected organization(s).
9.4 This Brokerage will respond to a request from an individual to correct information
within 30 days unless the organization has been granted an extension by the Information
and Privacy Commissioner.
9.5 Individuals can at any time withdraw or change their consent to the collection,
use, and disclosure of personal information. Individuals will be advised of the
consequences of any withdrawal or change in consent.
10.0 Compliance
10.1 Any complaints from an individual concerning the collection, use or disclosure
of their personal information or concerning the individual's ability to access their
personal information must be referred to the Privacy Officer, who will attempt to
resolve the complaint to the individual's satisfaction;
10.2 In the event the complaint cannot be resolved internally to the individual's
satisfaction, he or she will be advised of where to direct the complaint.
CONSENT TO GATHER INFORMATION
Should you choose to provide personal information online (or otherwise request information
from Seller Direct®), you hereby authorize a representative of Seller Direct® to
contact you.
